Mr. C.L. Murphy – Application to review suspension – Banned Substance – Cork 18th December 2018

The Referrals Committee, Justice Tony Hunt (in the chair) Mr. Anthony Byrne and Justice Leonie Reynolds convened remotely via Zoom on 28th October 2020 to consider an application by Mr. C.L. Murphy (Rider) to review the suspension imposed on him at a hearing on 10th January 2019 when the Referrals Committee had found Mr. Murphy in breach of Rule 277(i) and imposed a penalty of five years suspension of his licence but stated that he could reapply for a licence on 23rd July 2020 provided he complied with any requirement set by Dr. Jennifer Pugh (Senior Medical Officer IHRB).

 

The Committee considered written submissions from Mr. Conor Murphy and Dr. Jennifer Pugh.

 

Having considered the evidence, the Referrals Committee noted the positive engagement from Mr. Murphy, the fact that he has continually tested negative for prohibited substances when tested at random over an extended period of time by Dr. Pugh and changes in his lifestyle and professional life. As a consequence, they decided to suspend the remaining part of his suspension with immediate effect but reminded Mr. Murphy of his responsibilities and that were he to reoffend that the remaining part of his initial five year penalty would be imposed in addition to any other penalty that may be imposed for a new offence.
