M.P. Sheehy (Rider) Appeal – Fairyhouse 1st October 2020

The Appeals Body (Division 2), Mr. Peter M. Allen (in the chair) Dr. Colm O’Flaherty and Mr. Anthony Ryan convened at Limerick Racecourse on 10th October 2020 to consider the Appeal of M.P Sheehy (Rider) against the decision of the Stewards at Fairyhouse on 1st October 2020.

 

On the day, following the running of the Discover Boyne Valley Handicap, the Stewards found Mr. Sheehy in breach of Regulation 10.3(b), in that he had used his whip when his chance of winning or being placed was clearly gone, and they suspended him for two racedays. The grounds of the appeal lodged by Mr. Sheehy was that the Stewards erred in their decision.

 

Evidence was heard from Mr. Sheehy and the Appeals Body also watched a recording of the race.

 

In his evidence, Mr. Sheehy outlined a brief history of his mount, Gee Rex. He stated that he was familiar with the horse having previously won on him at Gowran Park and that he is a horse that sometimes can switch off easily. Mr. Sheehy added that on this occasion at Fairyhouse he had asked his mount for an effort two furlongs from home and when his mount stopped responding after a few strides he eased him down and the horse finished in his own time. In his opinion he encouraged his mount to chase the leading group by using his whip twice and to ensure he was seen to make sufficient effort in the closing stages but his horse didn’t respond to his urgings on this occasion so he put his whip down.

 

Having considered the evidence the Appeals Body allowed the appeal.

 

The case was presented by Mr. Liam Walsh, Stipendiary Steward. Mr. Sheehy was accompanied by Mr. Brendan Powell.
