K.J. Manning (Rider) Appeal – The Curragh 23rd October 2022

The Appeals Body (Division 2) Mr. Laurence McFerran (in the chair), Mr. Anthony Byrne and Mr. Noel McCaffrey convened at the Offices of the Irish Horseracing Regulatory Board on Friday 28th October 2022 to consider the appeal of Kevin Manning (Rider) against the decision of the Stewards at The Curragh on 23rd October 2022.

On the day, following the running of the SP Or Better Guaranteed With Tote Maiden, the Stewards found Mr. Manning, rider of Vocal Studies, in breach of Rule 214 in that he had ridden carelessly and having considered his record in this regard they suspended him for one raceday.

The grounds of appeal lodged by Mr. Manning was that the Stewards on the day erred in their decision.

At the Appeal Hearing, evidence was heard from Mr. Manning and the committee also watched a recording of the race.

In his evidence, Mr. Manning stated that he had been on the rail throughout the race and he was tracking Imaginarium and Colin Keane in the straight. Mr. Manning said that Imaginarium was travelling well while Painters Palette ridden by Donagh O’Connor was dropping away on his outside. Mr. Manning explained that he moved out as Painters Palette was dropping away and while he accepted he brushed off Painters Palette, he did not feel he had ridden carelessly.

Having considered the evidence, the Appeals Body dismissed the appeal.

The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.

Suspension Date: 6th November
