S.M. Levey Appeal

01 October 2009 S.M. Levey Appeal – Ballinrobe, 20th September 2009

The Appeals Body, Division Two, Mr. J.R. Craigie (in the Chair), Mrs. T.K. Cooper and Mrs. J.O. Onions met in the Turf Club, Curragh, Co. Kildare on 1st October 2009 to consider an appeal from S.M. Levey, rider, against the severity of the ban imposed by the Acting Stewards at Ballinrobe on 20th September 2009 when following the running of the EPS Pumps Handicap he was suspended for seven racedays for using his whip unnecessarily when out of contention on Viceroy of India (USA).

Evidence was heard from S.M. Levey.

Having considered the evidence the Appeals Body reduced the suspension to two racedays (October 4th and 7th) on the basis of S.M. Levey’s previous record.

The case was presented by Mr. Denis Egan, Chief Executive of the Turf Club.  S.M. Levey was represented by Andrew Coonan of Coonan Cawley Solicitors, Naas, Co. Kildare.
