The Referrals Committee, Mr. Edward Flannery (in the Chair), Mrs. T.K. Cooper and Mrs. J.O. Onions, met in the Stewards Room at the Curragh Racecourse on Wednesday, 22nd March, 2006, to consider a report from the BHP Laboratories in Limerick that the biological fluid sample taken from “Paddy The Soldier”, owned by Mrs. M.J. Brassil, following its win in the Maiden Race for 6-y-o & Upwards Geldings (Division II) at the Stonehall Harriers Point to Point meeting on 22nd January, 2006, was found to contain Phenylbutazone which, under Rule 20 (v), is a Prohibited Substance.  

The Committee heard evidence from Mr. M.J. Brassil, representing the owner, and from Mr. S.W.D. McIlveen, Turf Club Veterinary Officer, and having considered the evidence they fined Mr. Brassil €127 and disqualified “Paddy The Soldier” from first place and ordered the result to be amended accordingly, as follows:-

First:        The Paddy Premium
Second:    Boher Bui
Third:        High Step

However the Committee waived the fine because they were satisfied that the substance was administered unknowingly and the owner had taken all reasonable precautions to avoid a breach of the Rule.
