The Stewards interviewed Mr. D.P Kelly, trainer, regarding the late withdrawal of his charge Giant’s Quest (AUS) from this race due to ground conditions.
Evidence was heard from the trainer concerned, who stated that he agreed with the ground description of good, good to firm in places, and accepted that it was the same at declaration time, but explained that he would not run his charge on ground with firm in the description as the horse has had leg problems in the past. He added that the forecast had been for heavy, thundery showers last night and earlier today, but this forecast failed to materialise at the track. He explained how he took a chance driving here and not withdrawing the horse this morning in the hope that some rain would fall, but that did not happen. Having walked the track, he decided to withdraw in the best interests of his horse and apologised for being late.
Having considered the evidence, and having taken all the circumstances into account, the Stewards noted Mr Kelly’s explanations with regard to his excuse for withdrawing due to “ground conditions”. However, acting under the terms of Rule 194 (iv), the Stewards fined Mr. Kelly €200 for the late withdrawal of his charge.

Having considered the evidence, and having taken all the circumstances into account, the Stewards noted Mrs Harrington’s explanations with regard to the excuse for withdrawing due to “ground conditions”. However, acting under terms of Rule 194 (iv), the Stewards fined Mrs Harrington €200 for the late withdrawal of her charge.
221F malton.com Handicap Steeplechase & The Stewards enquired into the apparent improvement in form of the winner One Fine Morning (GB), trained by Mr. Ronald O’Leary, compared with the horse’s previous few runs.
Evidence was heard from the trainer concerned and from Mr. Andrew Shaw, Turf Club National Hunt Handicapper, who evaluated the apparent improvement in form for the Stewards.
In his evidence Mr O’Leary stated that, two runs ago at Wexford, the saddle slipped on his charge and he was pulled up. This was reported to the Stewards on the day. He thought that his charge had a chance that day, and so again expected a good run next time out at Roscommon. On this occasion his charge was in with a chance off the final bend, but did not seem to get home that day. He said the animal turned into the straight in fifth or sixth on that occasion, but faded to be beaten over 30 lengths. Being very disappointed with the run, he subsequently scoped his horse, but nothing showed up. He felt it was his horse’s last chance to show some improvement today and so he instructed his rider to race prominently and keep the horse interested. He said the horse jumped and travelled well on the fast ground. These tactics seemed to work today on fast ground, which the horse has shown a preference for in the past, and this appears to have brought about the apparent improvement in form.
Having considered the evidence, the Stewards noted the explanations offered.
The Stewards fined Mr. C. Roche, trainer of Stonesinmypocket, €200 for the late withdrawal of his charge from this race due to ground conditions.
D.N. Russell, rider of Best Result, trained by Mr. David Kenneth Budds, reported to the Stewards' Secretaries that his mount hung right in this race.

Evidence was heard from the rider concerned, who admitted he had used his whip with excessive frequency.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that Mr. P.A. King was in breach of Regulation 10, in that he had used his whip with excessive frequency. Having taken his record in this regard into account, the Stewards suspended him for four race days (11th, 12th, 13th and 14th September).

223C O’Keeffe O’Shea O’Connor Solicitors Handicap & The Stewards enquired into the apparent improvement in form of the winner Cul A Dun, trained by Mr. John Joseph Murphy, compared with the horse’s previous few runs.
Evidence was heard from the trainer concerned and from Mr. Gary O’Gorman, Senior Turf Club Flat Handicapper, who evaluated the apparent improvement in form for the Stewards.
In his evidence Mr. O’Gorman stated that Cul A Dun has run five times this year, all of which were disappointing, and the horse has been dropped 15 lbs since the start of the year.
In his evidence Mr. Murphy stated that the animal’s first number of runs this year were on quick ground. He said he felt the horse showed a disliking for fast ground, and that he came back sore after a couple of the runs. The horse had shown a preference for easy ground in the past and so it was decided to run him only when there was an ease in the ground. He said his charge has been ready to run for some time now but he was waiting for some suitable ground. He said he declared the horse for today based on the forecast rain, and the rain came and changed the ground to soft. He concluded by saying that any apparent improvement in form was attributable to this fact.
Having considered the evidence, the Stewards were of the opinion that Mr. Murphy was in breach of Rule 213, and in accordance with this Rule, they referred the matter to the Referrals Committee.
223D Ross Golf Club/Killarney Racegoers Club Handicap & The Stewards interviewed D.M. Grant, rider of the winner Binocular (GB), concerning his use of the whip in the closing stages.
Evidence was heard from the rider concerned, who admitted he had used his whip with excessive frequency. He stated that he had also used his whip in the forehand down the shoulder, but the Stewards accepted he only used it in this manner to avoid causing interference.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that D.M. Grant was in breach of Regulation 10 in that he had used his whip with excessive frequency. Having taken his recent record into account, the Stewards therefore suspended him for one race day (9th September).
Mr. Michael O’Driscoll, Acting Steward, absented himself from this enquiry.
223F M.L. Lynch Civil Engineering Ltd. Maiden Hurdle & D.E. Splaine, rider of Aliceaneileen, trained by Mr. Paul A. Roche, reported to the Stewards' Secretaries that his mount ran very free early on and hung left in this race.
223G Grand Hotel Killarney Handicap Hurdle &The Stewards interviewed Mr. Robert Murphy, trainer of Stylos Ace, in an attempt to establish the facts regarding the withdrawal of his charge by Order of The Stewards as it was their belief that no rider had been nominated for this reserve half an hour before the first race as stipulated in Regulation 3.
Evidence was heard from the trainer concerned and from Mr. Joesph Kelly, Turf Club Clerk of the Scales Assistant.

224A Smirnoff Maiden Hurdle & The Stewards enquired into the running and riding of Invincible Vibes, ridden by J.R. Barry, and trained by Mr. Eoin Doyle.
Evidence was heard from the rider concerned and also from Mr. Brendan O’Shea authorised representative for Mr. Doyle.
In his evidence J.R. Barry stated that his instructions were to settle his mount fifth or sixth, creep into the race and do his best. He added that his mount never really travelled and had to be niggled to stay on the bridle. The rider also felt that the horse did not stay the trip and consequently he sat up on him after the third last hurdle. He concluded by stating that the horse would be better suited to a sharper track with less emphasis on stamina.
In his evidence Mr. O’Shea confirmed the instructions and expressed his satisfaction with the ride.
Evidence was also heard from Mr. Noel O Brien, Senior Turf Club National Hunt Handicapper, who stated that today’s run was disappointing in relation to the horse’s previous run at Tramore, which he quantified as being in excess of a stone superior.
The Stewards also received a report from the Turf Club Veterinary Officer stating that Invincible Vibes was found to be post race normal.
Having viewed a recording of the race and considered the evidence, the Steward were of the opinion that both trainer and rider were in breach of Rule 212. Evidence was heard from the rider and trainer concerned.
In his evidence D.J. Condon stated that his instructions were to settle his mount in fourth or fifth place, creep into the race and to produce the horse late. He stated that his horse took a heavy fall on the way to the start but subsequently trotted to the start sound. He added that things did not really go according to plan, and having jumped off near the rear, the horse suffered an interrupted run throughout and was repeatedly denied a clear run. He also added that his mount landed awkwardly at the third last hurdle from which point he eased him up. He concluded by saying that his mount did not travel like he normally does.
In her evidence Miss MacMahon confirmed the instructions and expressed her satisfaction with the ride.
The Stewards also received a report from the Turf Club Veterinary Officer stating that Jamsie Hall was found to be post race normal.
Having viewed a recording of the race and considered the evidence, the Stewards noted the trainer’s explanation, while they cautioned D.J. Condon to be seen to make more of an effort in future.

Evidence was heard from the rider and trainer concerned.
In his evidence M.P. Walsh stated that his instructions were to settle his mount in behind the leaders before taking it up after the last. The rider added that his mount did not travel with his usual fluency in the latter stages of the race and needed to be niggled along. He also stated that he did not push his horse out vigorously down the hill as he was conscious of the fact that the horse jumped poorly in the Galway Plate at this venue previously and lost his confidence.
In his evidence Mr. Mullins confirmed the instructions and expressed his satisfaction with the ride.
The Stewards also received a report from the Turf Club Veterinary Officer stating that Dr. Whizz was found to be post race normal.

227A Mad About You European Breeders Fund Maiden & The Stewards interviewed Mr. James Stack, assistant trainer, representing Mr. T. Stack, trainer of Future Proof (GB), concerning the late arrival of their horse to the start which delayed the start of this race.
Mr. Stack stated that it had not been their intention to be late to the start, but he wanted the horse to leave the parade ring last and canter down. However the horse got very buzzy as he was about to leave the parade ring, and in order to insure the horse did not run away freely, he instructed his rider to take his time going down to the start.
Having considered the evidence, the Stewards reminded Mr. Stack, through his representative, of his responsibilities in this regard and advised him to make arrangements in future to seek permission to leave the parade ring early with this horse and thereby avoid a delay to the start.

227E Moyglare Stud Stakes & The Stewards interviewed Mr. P.J. Prendergast, trainer of Coral Wave, regarding the reason for the withdrawal of his charge from this race due to ground conditions.
Evidence was heard from the trainer concerned and from Mr. Brendan Sheridan, Turf Club Clerk of the Course.
In his evidence Mr. Sheridan explained that, in his opinion, the ground description today was the same as at declaration time as the heavy rainfall which was forecast never materialised at the track.
In his evidence Mr. Prendergast explained that he regretted not being able to run his filly. He said that, having declared on Friday morning and having walked the track a number of times during the week, all that was required was some of the forecasted rain to put a bit of yielding in the going description and he would have been happy to run. He explained that the final forfeit stage was last Tuesday and all the entry fees had been paid at this stage, and again, according to the forecast, he felt satisfied the ground would come up in his favour by today. However, despite heavy rainfall in surrounding areas, none fell on the track. He apologised to the Stewards but said he was trying to do the right thing for his filly.
Having considered the evidence, and the particular circumstances in this case, the Stewards were satisfied the reason for non running was a valid one and therefore imposed no fine.
