Rule 298 Referrals (Stable Employee Bonus Scheme)

The Referrals Committee, Philip Caffrey, (in the chair), Mrs. T.K. Cooper and N.B. Wachman met at the Turf Club, Curragh, Co. Kildare on 6thJuly 2012 to consider whether or not the above named trainers were individually in breach of Rule 298 as a result of their failure to comply with the terms and conditions of the Stable Employees Bonus Scheme. The cases were referred by Denis Egan, Chief Executive of the Turf Club as a result of each trainer’s failure to complete and return the relevant documentation to the Offices of the Governing Bodies by the nominated deadline to confirm that all monies deducted under the Stable Employees Bonus Scheme and paid to them had been paid over to their stable employees.


Evidence was heard from each of the trainers concerned.


Having considered the evidence, the Committee found each trainer in breach of Rule 298. Each trainer was cautioned and ordered to pay a contribution of €100 towards the Turf Club’s costs. In arriving at the penalties the Committee took into account that in seven of the cases the monies deducted had been paid to the employees within the required deadline even though the relevant confirmations had not been lodged with the Turf Club while in the other case there was an agreement with stable employees that monies would be paid every six months.
