The Appeals Body, Division Two, Mr. Raymond J. Rooney (in the Chair), Mr. C.E. O’Sullivan and Mr. Peter N. Reynolds, met in the Turf Club Offices, The Curragh, Co. Kildare, on Wednesday 19th March, 2008, to consider an appeal lodged by Robert C. Colgan, Professional Jockey, against the decision of the Acting Stewards at Gowran Park on Saturday 8th March, 2008, when following the running of the B.D.M. Stone Beginners Steeplechase, the rider was suspended for ten days and ordered to forfeit his riding fee for making insufficient effort.

Having considered evidence from the Rider, Mr. Lorcan Wyer, Stewards Secretary on duty, Mr. Patrick McGrath, MRCVS, and from Mr. A.J. Martin, Trainer, and having viewed a film of the race, the Appeals Body decided to dismiss the Appeal and ordered Mr. Colgan to pay €500 towards the cost incurred by the Turf Club.

Mr. Colgan was represented by Mr. Eugene Gleeson, SC, instructed by Mr. Charles Burke of Reidy Stafford Solicitors, Newbridge, Co. Kildare, and the case was presented to the Committee by Mr. Brian Price, Wilkinson and Price Solicitors, Naas, Co. Kildare.
