N. G. Hynds (Trainer) Referral - Stable Inspection 28th August 2019

The Referrals Committee, Mr. Justice Raymond Groarke (in the chair), Mr. Anthony Byrne and Mr. N.B. Wachman convened via Zoom on Tuesday, 28th January, to consider whether Noel Hynds (Trainer) was in breach of any rules as a result of a stable inspection carried out at his Training Establishment on 28th August 2019 by Irish Horseracing Regulatory Board officials.

On the day, the inspection team observed that the Medicines Register was not kept up to date under Rule 148(iii). Mr. Hynds was also riding out without a Body Protector as required under Rule 148(v)(b).

At the Referral Hearing, the committee heard evidence from Mr. Hynds and Ms. Colleen Murphy, IHRB Official.

In his evidence, Mr. Hynds stated that he had just one horse returned in training at the time but accepted that he had not kept his Medicines Register up to date. He also confirmed that he was not wearing a Body Protector on the day and stated that at the time he didn’t think he needed to wear one as the Trainer. He added that he was only lunging a horse and wasn’t riding out that morning.

In her evidence, Ms. Murphy confirmed that she witnessed Mr. Hynds riding out a horse on the morning of the inspection and that he was not wearing a Body Protector and said at the time that he didn’t feel he needed to wear one as he was the Trainer.

Having considered the evidence, the panel were satisfied that Mr. Hynds was in breach of Rule 148(iii) in that he had failed to keep his Medicines Register up to date and Rule148(v)(b) in that he was riding out without a Body Protector. Having considered his record in this regard the panel fined him €250 for the breach of Rule 148(iii) and €350 for the breach of Rule 148(v)(b).
