L.A. McKenna (Rider) Appeal – Downpatrick 17th September 2021

The Appeals Body (Division 2) Mr. Patrick J. Barry (in the chair) Mr. M.J. Doyle and Mr. S Mc Donogh convened at Listowel Racecourse on Thursday, 21st September 2021 to consider the Appeal of Liam McKenna (Rider) against the decision of the Stewards at Downpatrick on 17th September 2021.

On the day, following the running of the Bill McIlroy Bookmaker Maiden Hurdle, the Stewards suspended Mr. McKenna, rider of Eternal Prince (GB) for one raceday having found him in breach of Rule 208, in that he had failed to comply with the instruction of the Starter. The grounds of appeal lodged by Mr. McKenna was that the Stewards had erred in their decision.

Evidence was heard from Mr. McKenna and the Appeals Body also watched a recording of the race and considered a written submission from Mr. J.J. Lambe, trainer of Eternal Prince (GB).

In his evidence, Mr. McKenna stated that it was never his intention to make the running in this race as was confirmed by Mr. Lambe in his written submission. He said that his mount was wearing cheek-pieces for the first time and was proving difficult at the start. Mr. Kenna said it wasn’t his intention to break the start to get an advantage and as soon as he realised there was a false start he pulled his mount up straight away.

Having considered the evidence the Appeals Body did not feel that the Stewards on the day erred in their decision and dismissed the appeal in its entirety.
