Jarlath P. Fahey (Trainer) Identity Query Referral - Naas 12th February 2022

The Referrals Committee, Mr. Justice Raymond Groarke (in the chair), Mr. Peter M. Allen, and Mr. Nicholas Wachman convened at the Offices of the Irish Horseracing Regulatory Board on Monday, 23rd May 2022, to consider the referral of Jarlath Fahey (Trainer) in relation to the identification of Elusive Guy which was due to run on 12th February 2022 at Naas.

On the day, the identity of the horse could not be confirmed owing to the failure to locate the microchip number and was therefore withdrawn by the Stewards.

At the Referral Hearing, the committee considered a written submission from Mr. Fahey.

In his submission, Mr. Fahey accepted that when Elusive Guy was presented to run at Naas the microchip was unable to be located. He stated that on 14th February 2022 he got his own vet to attend the yard and he was also unable to find the microchip so it was decided to remark the horse, take new blood samples and insert a new microchip. Elusive Guy’s passport, new markings and bloods were delivered to Weatherbys on 15thFebruary 2022.

Having considered the evidence, the Referrals Committee were satisfied that Mr. Fahey was in breach of Rule 90 in that the identity of the horse could not be positively identified. Having considered his record in this regard, they imposed a fine of €350 for a breach of Rule 90.
