The Appeals Body (Division 2) Mr. Peter M. Allen, Mr. Anthony Byrne and Mr. Michael C. Hickey convened via Zoom on Friday 16th September 2022 to consider the appeal of Joey Sheridan (Rider) against the decision of the Stewards at Laytown on 8th September 2022.

On the day, following the running of the Tote Guarantee On All Irish & UK Handicap, the Stewards found Mr. Sheridan, rider of No Speed Limit, in breach of Rule 231 in that he had weighed in at 1.1lb overweight and having considered his regard in this regard they suspended him for one racedays.

The grounds of appeal lodged by Mr. Sheridan was that he wasn’t afforded the opportunity to make the correct weight.

At the Appeal Hearing, evidence was heard from Mr. Sheridan.

In his evidence, Mr. Sheridan explained that he had initially weighed in overweight but removed the breast girth and he was unaware that he remained overweight at this point. He stated that Laytown is a unique fixture with higher than normal weights and that he was using a big saddle and had a lead bag but that he could have returned heavy due to the kickback from the sand and moisture on his equipment. Mr. Sheridan added that he felt he could have made the correct weight if being afforded another opportunity to remove his goggles and gloves.

Having considered the evidence, the Appeals Body found Mr. Sheridan was in breach of Rule 231 in that he had weighed in at 1.1lb overweight and dismissed the appeal.

The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.

Dates of suspension: 22nd September
