257B Byrne Family H'cap

The Stewards enquired into the running and riding of Bigger And Better (GB), ridden by R.C. Colgan, and trained by A.J.Martin. Evidence was heard from the rider and trainer concerned. R.C. Colgan stated that he was instructed to keep behind the leaders and to follow the pace. He stated that his mount jumped off well from stalls however after the first furlong, and despite being pushed on, he could not get anywhere near a winning position and ran badly. In the closing stages, R.C. Colgan missed a gap and when he eventually found room horses in front of him stopped and he passed tired horses to finish second. R.C. Colgan finished by adding that in his opinion he could not have finished closer to the winner, however through his own fault he was too far off the pace. A.J.Martin confirmed the riding instructions given to R.C. Colgan and added that he was disappointed with his charge's finishing position who could have been encouraged more in the back straight, however he was satisfied with the evidence of R.C. Colgan who he stated is an experienced rider. The Stewards also received a report from the Irish Horseracing Regulatory Board Veterinary Officer who stated that Bigger And Better was post race normal. Having viewed the recording of the race and considered the evidence, the Stewards noted the explanation offered by A.J. Martin and were satisfied that R.C. Colgan was in breach of Rule 212 A (ii), in that he failed to obtain from his mount timely and substantial efforts to achieve the best possible place. Having considered R.C. Colgan's record in this regard, the Stewards suspended him for 5 racedays and ordered him to forfeit his riding fee.

The Stewards received a report from the Clerk of the Scales, Ms A. O'Keeffe, that N.M. Crosse, rider of Romantically, failed to present himself to be weighed out within the appointed time for this race. Evidence was heard from Mr. E. Dempsey, Authorised Representative of Mr. W. McCreery, trainer of Romantically, who stated that due to confusion earlier in the morning, N.M. Crosse was not present at the racecourse, and he also requested permission for W.J. Lee to substitute N.M. Crosse. Having considered the evidence, the Stewards, under Rule 195, allowed Romantically to run and to be ridden by W.J. Lee. The Stewards were satisfied that N.M. Crosse was in breach of Rule 196 in that he failed to present himself to be weighed out before the appointed time, and they therefore fined him €200. The Stewards also reminded Mr. W. McCreery,through his Authorised Representative, of a trainer's responsibilities under Rule 153 (i) to ensure that where his apprentice has a riding arrangement that he is present on the racecourse in adequate time to fulfil that engagement.

The Stewards received an objection from the Clerk of the Scales, Ms. A. O'Keeffe, regarding the weighing in procedure following this race, as Mr R. Sugrue, rider of Coolmill, placed fifth, failed to weigh in. Evidence was heard from the rider concerned who stated that this was as an oversight and genuine error on his behalf. Sugrue was in breach of Rule 227 in that he had failed to present himself to weigh in, and having considered his record in this regard, suspended him for 2 racedays. Furthermore, under Rule 230 the Stewards disqualified Coolmill from fifth place. The Result now reads;
